Introduction and Binding Effect
This Terms and Conditions Agreement ("Agreement") constitutes a legally binding and enforceable contract between FINCART FINVEST PRIVATE LIMITED, a company incorporated under the Companies Act, 2013, having Corporate Identification Number U74120UP2015PTC072806 and its registered office at NCPL Tower, 2nd Floor, A-4, A Block, Sector 9, Noida, Uttar Pradesh – 201301, India (hereinafter referred to as "Fincart", "Company", "we", "us", or "our") and every user, visitor, client, customer, investor, borrower, insured person, corporate representative, or any person accessing the Platform (hereinafter referred to as "User", "you", or "your").
This Agreement governs the access to and use of the Company's website, mobile application, dashboards, calculators, client desk, partner desk, APIs, forms, digital onboarding systems, campaign pages, and all other digital interfaces, whether now existing or introduced in the future (collectively, the "Platform"). By accessing, browsing, registering, clicking acceptance, submitting any information, using any tool or calculator, availing any service, or continuing to use the Platform in any manner whatsoever, you irrevocably acknowledge and agree that you have read, understood, and accepted this Agreement, the Privacy Policy, Disclaimer, Cookie Policy, consent forms, and all service-specific disclosures.
This document is an electronic record under the Information Technology Act, 2000 and shall not require any physical or digital signature to be legally enforceable.
About Fincart and Regulatory Position
Fincart is engaged in the business of distribution, facilitation, referral, onboarding, and support services in relation to financial products and allied services, including but not limited to mutual funds, SIPs, step-up SIPs, portfolio management services, digital gold, fixed income products, retirement planning, loans, insurance, calculators, workshops, corporate NPS, employee benefit solutions, and related financial wellness services. The Company may act as an AMFI-registered mutual fund distributor, IRDAI-authorised insurance intermediary, DSA / referral partner for loan products, and service facilitator for third-party regulated products.
It is expressly clarified that unless specifically stated under applicable law, Fincart does not provide SEBI-regulated investment advisory services and nothing on the Platform shall be construed as fiduciary advice, guaranteed recommendation, or assured financial outcome.
Click-Wrap Acceptance and Electronic Consent
By clicking on "I Agree", "Accept", "Continue", or any similar button, or by accessing or using the Platform in any manner, you expressly acknowledge and agree that you have read, understood, and consented to be bound by these Terms and Conditions. Such acceptance shall constitute a valid and binding electronic consent under applicable laws, including the Information Technology Act, 2000, and shall be deemed equivalent to your physical signature.
You further agree that your continued use of the Platform following any updates or modifications to these Terms shall constitute your acceptance of such revised Terms. In the event that you do not agree to any revised Terms, you must immediately cease using the Platform.
Eligibility, Representations, and User Warranties
By using the Platform, you expressly represent, warrant, and covenant that you are at least 18 years of age, legally competent to contract, of sound mind, and not disqualified under any applicable law from availing financial services. You further warrant that all information, declarations, KYC documents, financial data, identity proofs, address proofs, bank account details, tax details, and any other information submitted by you are true, complete, valid, current, and not misleading in any manner.
Any misrepresentation, concealment, fraudulent declaration, or use of forged documentation shall constitute a material breach entitling Fincart to suspend services, terminate access, report to regulatory authorities, and pursue legal remedies.
Registration, KYC, Data Verification, and Consent
The User expressly consents to KYC, CKYC, PAN verification, Aadhaar authentication where legally permitted, bank account validation, FATCA / CRS declarations, income and employment checks, risk profiling, credit checks, and all other verification procedures necessary for providing the services. The Company may share, receive, process, verify, and store such information with and from third-party institutions including AMCs, insurers, lenders, NBFCs, banks, payment aggregators, account aggregators, registrars, service providers, and statutory authorities.
The User further irrevocably authorises Fincart to rely upon all electronic submissions, OTP validations, e-signs, consents, click-wrap acceptances, mandates, and digitally executed forms as valid and binding.
Nature of Platform and Scope of Services
Fincart operates as a technology-driven platform that facilitates access to a range of financial products and services offered by third-party institutions. The services made available through the Platform include, without limitation, financial planning services such as financial planning, investment planning, goal planning, risk management, tax planning, and retirement planning; investment-related services such as mutual fund facilitation, systematic investment plans (SIPs), portfolio-related services, and gold investments; loan facilitation services including home loans, personal loans, and business loans; insurance distribution services including health insurance, term insurance, critical illness insurance, and asset insurance; as well as corporate and advisory services including workshops, corporate National Pension System (NPS), and group insurance solutions.
It is expressly clarified that Fincart acts solely as a facilitator, intermediary, or distributor and does not manufacture, underwrite, manage, or control any financial product or service offered on the Platform. All financial products are offered by third-party service providers, and any transaction entered into by the User shall be directly between the User and such third-party provider and governed by their respective terms and conditions.
Regulatory Status and Non-Advisory Position
Fincart is not registered with the Securities and Exchange Board of India (SEBI) as an Investment Adviser and does not provide investment advisory services regulated under SEBI (Investment Advisers) Regulations. The Company operates under applicable registrations including IRDAI Registration No. CA0877, AMFI Registration Number ARN-112744, and APMI Registration Number APRN02815.
All information, tools, financial plans, projections, calculators, and indicative recommendations made available through the Platform are provided solely for informational and facilitative purposes and shall not be construed as financial advice, investment advice, legal advice, or tax advice. No fiduciary, advisory, or trust-based relationship is created between the User and Fincart, and Users are solely responsible for evaluating the suitability of any financial product or service.
User Categories and Access to Services
Users may access the Platform as visitors, registered users, or verified users who have completed the required onboarding and KYC processes. Certain features and services may be restricted based on the level of registration or verification completed by the User.
Fincart reserves the absolute right, at its sole discretion, to determine eligibility for access to any service, to restrict or suspend access to any part of the Platform, or to deny services to any User without assigning any reason.
Account Registration, KYC Compliance, and Information Accuracy
In order to access certain services, Users may be required to create an account and provide personal, financial, and identification information including but not limited to Permanent Account Number (PAN), Aadhaar details, bank account information, and other Know Your Customer (KYC) documentation as required under applicable laws and regulations.
By providing such information, you represent and warrant that all information furnished by you is true, accurate, complete, and up to date. You agree to promptly update such information in the event of any changes. Fincart reserves the right to verify such information through internal or third-party verification mechanisms and may suspend, restrict, or terminate your account if any information is found to be false, misleading, or inconsistent.
Fincart shall not be liable for any losses, delays, or inability to provide services arising from inaccurate, incomplete, or outdated information provided by you.
User Obligations and Acceptable Use
You agree to use the Platform strictly in accordance with applicable laws, regulations, and these Terms. You shall not engage in any fraudulent, unlawful, misleading, or manipulative activities, including but not limited to impersonation, misrepresentation, unauthorized transactions, or misuse of the Platform.
You further agree not to attempt to gain unauthorized access to any part of the Platform, interfere with its operation, introduce malicious software, reverse engineer any part of the Platform, or otherwise engage in activities that may harm the Platform, the Company, or other Users.
Any violation of this clause may result in immediate suspension or termination of your access to the Platform, without prejudice to any other legal remedies available to Fincart.
User Credentials and Account Security
You are solely responsible for maintaining the confidentiality and security of your login credentials, including your username, password, OTPs, and any other authentication mechanisms used to access the Platform. All activities carried out through your account shall be deemed to have been authorized by you.
Fincart shall not be liable for any unauthorized access, misuse, or fraudulent activity arising from your failure to safeguard your credentials. You agree to immediately notify Fincart in the event of any suspected or actual unauthorized use of your account or any security breach.
Electronic Instructions, Communications, and Records
All instructions, communications, transactions, and activities carried out through the Platform shall be deemed to be final, binding, and conclusive. You acknowledge that Fincart may rely upon such electronic instructions without any obligation to verify their authenticity.
You further agree that all electronic records, system logs, transaction data, and communications maintained by Fincart shall be admissible as evidence in any legal or regulatory proceedings and shall be binding upon you. Fincart shall not be responsible for any delay, failure, or inaccuracy in the transmission of electronic instructions due to technical issues or other factors beyond its control.
Third-Party Services and Integrations
The Platform may provide access to or integrate with third-party service providers including banks, non-banking financial companies (NBFCs), mutual fund platforms, insurance companies, account aggregators, and payment gateways. Fincart does not control, monitor, or guarantee the services provided by such third parties.
All transactions entered into by you with such third parties shall be governed solely by their respective terms and conditions, and Fincart shall not be liable for any acts, omissions, errors, delays, or deficiencies on the part of such third parties. You acknowledge that your interactions with such third parties are at your own risk.
Investment Risk Disclosure and User Responsibility
You acknowledge and agree that all financial products and services involve inherent risks, including but not limited to market risk, credit risk, liquidity risk, and regulatory risk. There is no assurance or guarantee of returns, profits, or preservation of capital.
You agree that all financial and investment decisions made by you are based on your independent judgment and discretion, and you shall bear all risks and consequences arising therefrom. Fincart shall not be responsible for any financial losses or adverse outcomes resulting from such decisions.
Service-Specific Disclaimers
In respect of investment services, Fincart acts only as a facilitator or distributor and does not guarantee returns or performance of any financial product. In respect of loan facilitation services, Fincart does not guarantee approval, disbursement, or terms of any loan, which are determined solely by the respective lenders. In respect of insurance services, all policies are issued and managed by third-party insurers, and Fincart shall not be responsible for claim settlements or disputes. In respect of workshops and corporate services, such services are educational in nature and do not constitute professional advice.
Intellectual Property Rights
All content, materials, software, design elements, trademarks, and intellectual property available on the Platform are the exclusive property of Fincart or its licensors and are protected under applicable laws. You shall not copy, reproduce, distribute, modify, or commercially exploit any such content without prior written consent.
Data Usage, Consent, and Account Aggregator Framework
By using the Platform, you expressly consent to the collection, storage, processing, and sharing of your personal and financial information for the purpose of providing services, regulatory compliance, fraud prevention, and business operations.
You further consent to the retrieval and sharing of your financial data through account aggregators and other authorized entities in accordance with applicable laws, including the Digital Personal Data Protection Act, 2023 and relevant regulatory frameworks.
Fincart shall not be liable for any misuse or unauthorized access of such data by third parties beyond its control.
Mutual Fund, SIP, Step-Up SIP, and Investment Services
Fincart facilitates access to mutual fund investments, SIPs, top-up SIPs, step-up SIPs, tax-saving funds, debt funds, hybrid funds, liquid funds, corporate bond funds, gilt funds, and related investment products through third-party AMCs, RTAs, exchanges, and authorised platforms. All such products are subject to market risk, liquidity risk, volatility risk, concentration risk, taxation risk, and regulatory risk.
The User expressly acknowledges that all returns displayed through SIP calculators, projections, illustrations, growth graphs, and future value estimates are merely indicative and based on assumed rates of return, inflation assumptions, compounding formulas, and historical simulations. Fincart makes no warranty whatsoever regarding actual returns, capital preservation, or achievement of any target corpus.
Group Investment
The Platform may, at its sole discretion, provide a Group Investment feature whereby a designated user identified as the "Group Leader" may create, manage, operate, and execute investment transactions on behalf of one or more other users identified as "Members" forming part of such group arrangement. Under this feature, it is expressly understood and agreed that the sole authority to initiate, modify, redeem, switch, increase, decrease, pause, or otherwise transact in any investment made through the group investment account shall vest exclusively with the Group Leader, and no Member shall possess any independent transactional authority in relation to such group investment account unless expressly enabled by the Platform in writing.
It is further expressly acknowledged and agreed by all users availing this feature that the login credentials, including username, password, OTP-enabled access, device access, or any other authentication mechanism linked to the group investment account, shall belong solely to the Group Leader, and any access provided by the Group Leader to any Member for the purpose of viewing portfolio details, holdings, investment status, returns, transaction history, performance reports, or any other account-related information shall be entirely at the sole risk, discretion, and responsibility of the Group Leader.
Where the Group Leader voluntarily shares, discloses, communicates, permits access to, or otherwise allows any Member or third party to use the Group Leader's login credentials, such sharing shall constitute express authorization and deemed consent by the Group Leader for all actions undertaken through such credentials, whether such actions are intended, accidental, negligent, or unauthorized. The Company shall be entitled to conclusively presume that every action, instruction, transaction request, modification, redemption request, nominee change, bank detail update, mandate registration, profile alteration, communication preference update, or any other change initiated using the Group Leader's credentials has been duly authorized by the Group Leader, and the Company shall have no obligation whatsoever to independently verify whether such action was personally carried out by the Group Leader or by any Member or third party having access to such credentials.
The Group Leader expressly acknowledges that there exists a possibility that any Member having access to the shared login credentials may, with or without the knowledge, authority, or permission of the Group Leader, make changes to the group investment account, alter investment instructions, update details, or perform any account-related activity, and the Group Leader shall bear full and exclusive responsibility for all consequences arising from such access. The Company shall not be liable for any direct, indirect, consequential, financial, reputational, tax-related, regulatory, or investment loss arising out of any such acts, omissions, misuse, unauthorized changes, fraudulent conduct, mistaken transactions, or disputes between the Group Leader and the Members.
It is further clarified that the Company acts solely as a technology and facilitation platform and shall not be responsible for monitoring internal arrangements, contribution ratios, ownership rights, beneficial interests, oral agreements, reimbursement understandings, profit-sharing arrangements, obligations, or disputes among the Group Leader and Members in relation to the group investment account. All such arrangements shall remain strictly private arrangements between the concerned users, and the Company shall not be made a party to any civil, criminal, regulatory, financial, or contractual dispute arising therefrom.
The Group Leader and all Members expressly agree to indemnify and hold harmless the Company, its directors, officers, employees, affiliates, agents, and service providers from and against any claims, disputes, losses, liabilities, proceedings, penalties, damages, costs, or expenses arising out of or relating to shared credential access, unauthorized changes, misuse of credentials, internal disputes, contribution claims, withdrawal claims, or ownership disputes in relation to the group investment feature.
For abundant clarity, the Company strongly discourages the sharing of login credentials with any Member or third party, and any such sharing shall be deemed to have been undertaken voluntarily and entirely at the users' own risk.
PMS, Fixed Income, Digital Gold, and Alternative Products
Where the Platform facilitates PMS, fixed income products, corporate FDs, bonds, digital gold, or products such as Liquiloans / P2P instruments, Fincart acts solely as an intermediary, distributor, or onboarding facilitator. The actual issuer, lender, vault provider, or SEBI / RBI regulated entity shall remain solely responsible for product issuance, redemption, settlement, custody, interest payments, or return obligations.
The User expressly accepts credit risk, default risk, issuer insolvency risk, valuation risk, redemption risk, and market-linked pricing risk.
Loan Facilitation Services
Fincart operates as an intermediary facilitating connections between Users and third-party lenders, including banks and non-banking financial companies (NBFCs), for the purpose of availing loan products such as home loans, personal loans, and business loans.
The User acknowledges that Fincart does not act as a lender and does not provide any form of credit. All loan applications submitted through the Platform are subject to evaluation, approval, and disbursement at the sole discretion of the respective lender, based on their internal credit policies, risk assessment criteria, and regulatory requirements.
Fincart does not guarantee approval of any loan application, nor does it guarantee any specific interest rate, loan amount, tenure, or other terms. Any indicative information displayed on the Platform is subject to change and shall not be construed as a binding offer.
The User agrees that all loan agreements shall be executed directly between the User and the lender, and shall be governed exclusively by the terms and conditions of the respective lender. Fincart shall not be a party to such agreements and shall not be liable for any disputes, defaults, recovery actions, penalties, or obligations arising from such loan transactions.
The User further acknowledges that Fincart shall not be responsible for any delay in processing, rejection of applications, miscommunication, or change in terms by the lender, and all such matters shall be addressed directly with the lender.
Insurance Services
Fincart acts as a distributor of insurance products offered by third-party insurance companies registered with the Insurance Regulatory and Development Authority of India (IRDAI). The Platform may enable Users to purchase insurance products including health insurance, term insurance, critical illness insurance, and asset insurance.
The User acknowledges that all insurance policies are underwritten, issued, and administered solely by the respective insurance companies. Fincart does not assume any liability for underwriting, claim processing, settlement, or policy servicing.
All policy terms, including coverage, exclusions, premium payments, renewals, and claim procedures, shall be governed exclusively by the policy documents issued by the insurer. Users are advised to carefully review such documents before purchasing any insurance product.
Fincart shall not be liable for rejection or delay of claims, disputes arising between the User and the insurer, or any deficiency in service by the insurance company. Any claim-related matters shall be addressed directly with the respective insurer.
The User agrees that Fincart does not guarantee issuance of policies or approval of claims and shall not be responsible for any outcomes arising from insurance transactions.
Financial Planning, Goal Planning, Tax, and Retirement Calculators
This Annexure governs the financial planning tools, calculators, projections, and indicative recommendations made available through the Platform.
Fincart may provide financial planning assistance, asset allocation suggestions, goal-based planning tools, retirement planning calculators, tax planning insights, and other analytical tools based on the information provided by the User.
The User acknowledges that such tools are based on assumptions, algorithms, historical data, and user inputs, and may not be accurate, complete, or suitable for all Users. The outputs generated by such tools are indicative in nature and are intended solely for informational purposes.
Fincart does not provide investment advice, tax advice, or legal advice through such tools, and the User shall not rely solely on such outputs for making financial decisions.
The User agrees that any decision taken based on such tools or recommendations is at their own risk, and Fincart shall not be liable for any financial loss or consequences arising from reliance on such tools.
Workshops, Corporate NPS, Group Health, and Employee Benefit Services
Fincart may organize workshops, training sessions, financial awareness programs, corporate National Pension System (NPS) facilitation, and group insurance services for individuals and organizations.
The User acknowledges that such workshops and sessions are educational and informational in nature and are not intended to provide personalized financial advice or guarantees of financial outcomes.
Participation in such programs is voluntary, and the User agrees that Fincart shall not be liable for any decisions, actions, or outcomes arising from such participation.
In respect of corporate NPS and group insurance services, Fincart acts as a facilitator and intermediary, and all services are ultimately provided by the respective third-party institutions. The terms governing such services shall be determined by the respective service providers.
Fincart shall not be responsible for any deficiencies, delays, or disputes arising in relation to such services.
User Obligations, Prohibited Conduct, and Indemnities
The User shall not misuse the Platform, provide false data, impersonate any person, bypass controls, reverse engineer systems, scrape data, distribute malicious code, or interfere with service operations.
The User shall fully indemnify and hold harmless Fincart, its directors, employees, affiliates, consultants, agents, and service partners against all claims, liabilities, losses, costs, damages, regulatory actions, penalties, and legal expenses arising from any breach, misrepresentation, misuse, fraud, or third-party claim attributable to the User.
Limitation of Liability and Disclaimers
To the maximum extent permissible under law, Fincart shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages, including financial losses, loss of opportunity, tax losses, loss of returns, business interruption, system outages, cyber incidents, third-party failures, data loss, unauthorized access, or regulatory actions.
Force Majeure
Fincart shall not be responsible for any delay, interruption, or failure caused by acts of God, pandemics, cyber attacks, governmental restrictions, telecom outages, banking failures, market suspensions, exchange disruptions, force majeure events, or any cause beyond its reasonable control.
Governing Law, Dispute Resolution, and Jurisdiction
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform, the parties shall first attempt to resolve the dispute amicably through mutual discussions. If the dispute is not resolved within thirty (30) days, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996.
The arbitration shall be conducted by a sole arbitrator appointed by Fincart, and the seat and venue of arbitration shall be Delhi, India. The proceedings shall be conducted in English and shall remain confidential. The arbitral award shall be final and binding on the parties.
To the maximum extent permitted by law, you agree that any dispute shall be resolved on an individual basis, and you waive any right to participate in class action or collective proceedings.
Modification and Survival
Fincart reserves the absolute right to amend, modify, replace, or update these Terms at any time without prior notice. Continued use of the Platform shall constitute unconditional acceptance of such revised terms. Clauses relating to indemnity, liability, dispute resolution, confidentiality, and regulatory compliance shall survive termination.
Grievance Redressal Mechanism

The Company shall make reasonable efforts to acknowledge and resolve grievances within the timelines prescribed under applicable laws.
Miscellaneous
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be severed and the remaining provisions shall continue in full force and effect. The failure of Fincart to enforce any provision shall not constitute a waiver of its rights.
SIP Calculator
The SIP calculator available on the Platform is provided for informational and illustrative purposes only and is based on certain assumptions, inputs, and indicative rates of return. The results generated by the calculator represent approximate values and do not guarantee or assure any actual returns.
The calculations do not account for market volatility, fund performance, expense ratios, taxes, or other factors that may affect actual investment outcomes. Accordingly, the actual returns may differ significantly from the results displayed.
The User acknowledges that the SIP calculator is not a financial planning tool or investment advice of any nature and should not be relied upon as the sole basis for making investment decisions.Fincart acts as a SEBI-registered Mutual Fund Distributor (ARN-112744) and not as a SEBI Registered Investment Adviser. Users are advised to conduct their own analysis and/or seek professional advice before investing.
Fincart shall not be responsible or liable for any decisions made or losses incurred based on the use of the SIP calculator or reliance on its results.
Step-up SIP Calculator
The Step-up SIP calculator available on the Platform is provided solely for informational and illustrative purposes and is based on certain assumptions, including periodic increase in investment amount, indicative rates of return, and user-provided inputs. The results generated by the calculator are approximate in nature and do not represent actual or guaranteed returns.
The calculator does not take into account various real-world factors including market fluctuations, fund performance variability, expense ratios, taxation, changes in step-up frequency or amount, or other economic and regulatory conditions that may materially impact actual investment outcomes. Accordingly, the actual returns may differ significantly from the projections displayed.
The User acknowledges that the Step-up SIP calculator is not intended to provide financial advice, investment advice, portfolio recommendations, or any fiduciary or personalized advisory service and should not be relied upon as the sole basis for making investment decisions. Fincart is a SEBI-registered Mutual Fund Distributor (ARN-112744) and is not a SEBI Registered Investment Advisor (RIA). Users are advised to independently evaluate their financial situation and consult qualified financial, legal, or tax advisors before making any investment.
Fincart shall not be responsible or liable for any losses, damages, or consequences arising from the use of the Step-up SIP calculator or reliance on the results generated therein.
Financial Goal Planning Calculator
The Financial Goal Planning Calculator available on the Platform is provided solely for informational, illustrative, and educational purposes and is based on certain assumptions, user-provided inputs, and indicative financial parameters including expected rate of return, inflation rate, investment duration, and current savings.
The results generated by the calculator are approximate in nature and are derived using standard financial formulas, including projections based on the future value of money. Such calculations are indicative only and do not guarantee or assure actual investment outcomes or achievement of financial goals.
The calculator does not take into account various real-world factors including market fluctuations, changes in interest rates, fund performance variability, taxation, expense ratios, economic conditions, regulatory changes, or deviations in user behaviour such as missed investments or changes in contribution amounts. Accordingly, the actual results may differ materially from the projections displayed.
The User acknowledges that the Financial Goal Planning Calculator is not a substitute for professional financial planning or investment advice of any kind and should not be relied upon as the sole basis for making financial or investment decisions. Fincart is a SEBI-registered Mutual Fund Distributor (ARN-112744) and is not a SEBI Registered Investment Advisor (RIA). The results produced by this calculator do not constitute investment advice, personalized financial planning, or any fiduciary recommendation. Users are advised to independently evaluate their financial objectives, risk tolerance, and investment horizon and to seek advice from qualified financial, legal, or tax professionals before making any decisions.
Fincart shall not be responsible or liable for any losses, damages, or consequences arising from the use of the Financial Goal Planning Calculator or reliance on the results generated therein.
Retirement Calculator
The Retirement Calculator made available on the Platform is provided solely for informational, illustrative, and educational purposes and is intended to assist users in estimating their potential retirement corpus, monthly savings requirements, and future financial needs based on certain assumptions and user-provided inputs.
The results generated by the Retirement Calculator are approximate in nature and are based on multiple variables including, but not limited to, current age, retirement age, life expectancy, income levels, existing savings, expected rate of return, inflation rate, and projected expenses.
